Alexpanda's Terms and Conditions for Purchasing VTuber Models

By purchasing a Live2D model from me, whether it’s commissioned or premade, you agree to the following terms:

  • All payments will be made in USD. All prices are also in USD.
  • All payments will be made over PayPal.
  • My primary point of contact is through Twitter direct messaging @alexpandab. Another acceptable point is through email at [email protected].
  • My models are of original characters. Rights are shared between the character design and the model.
  • Purchases are for personal, non-commercial, and non-profit use only. For licensing for the model and character, please contact me for an additional licensing charge of 200 USD.
    • Examples of acceptable non-commercial use include using the model in a stream or video, making fan art of the character, setting an image of the character as a profile picture or other social media display, and using the model in thumbnails.
    • Examples of unacceptable non-commercial use, also known as commercial use, include selling merchandise featuring the character or selling the model and/or character design.
  • Unless the licensed charge is paid, I am allowed to promote the model as references in portfolios and self-promotional places, like social media banners.
  • Prior to a purchase, the following is required:
    • A PayPal account.
    • The appropriate funds for the purchase. If you wish to split payments for a week or two, we can negotiate it.

By applying for a commission, you agree to all of the previous terms where applicable, as well as the following:

  • All payments will be made prior to the commission beginning.
  • You may expect around 200-400 USD for the illustration and 400-600 USD for rigging, but prices will vary depending on the complexity of the model. Please reach out for a quote before committing to a commission. The presented ranges are not definite, and prices can be outside the range.
  • If you do not accept the invoice within 48 hours of receiving it, your commission may be declined.
  • Any commissioned illustration will be “cut” for Live2D usage. This means different aspects like the arms and legs will be in different layers.
  • I will do my best to accept any theme for the commission, but please clear it through me first. This includes complex/specialized topics like mecha and furry, as well as sensitive topics like pornographic or fetish topics.
  • I reserve the right to refuse any commission (i.e. if I feel unqualified or uncomfortable with completing it), but I’ll keep an open mind.
  • Mature themes will not be accepted if you are a legal minor.
  • Prior to commissioning, you must have a clearly thought out commission idea. This can either be presented in descriptive text, an image, or both.
  • Commissions are expected to take anywhere from two weeks to three months depending on its complexity. This is not a guarantee.

Illustration Commission Process/Revisions:

  • You will be allowed to make major changes to the sketch a maximum of three times.
  • You will be given frequent updates throughout the illustration. You may request small changes throughout the process.
  • After the illustration is completed, you may request a maximum of three changes. After the maximum has been reached, you will incur additional charges for further changes.

Rigging Commission Process/Revisions:

  • You will be given frequent updates throughout the rigging process. You may request small changes throughout the process.
  • Changes may include the ways parts move or what parts have what physics.
  • After the rig is completed, you may request a maximum of three changes. After the maximum has been reached, you will incur additional charges for further changes.

Commission Refunds:

  • You may request a partial refund at any point in a commission.
    • I will base the refund off of what has not been done using my best judgement.
    • For example, if you have commissioned an illustration and I have only finished the sketch, you will be refunded about 75%.
    • For example, if you have commissioned a rig and I have finished everything but the VTube Studio settings (if you are using VTube Studio), you will be refunded about 25%.
  • If the commission is not finished with in nine months of the final payment, a full refund is available. This term overrides previous terms for refunds.
  • If at any point I cancel the commission, you will be issued a full refund. For instance, if something happens where I deem myself to be no longer able to complete the commission, I may cancel the commission.

By purchasing a premade model, you agree to all of the previous terms where applicable, as well as the following:

  • All payments will be made prior to receiving the model.
  • The posted prices are final and will not be negotiated.
  • Refunds will be accepted before your first usage in a public video or stream. After you have featured the model or character design in a public video or stream, the product is no longer refundable.

Upon purchasing a model or at the end of a rigging commission, you will receive the following:

  • The .moc3 Live2D model along with its necessary files, including expression JSON files and textures.
  • VTube Studio configuration files if you are using VTube Studio.
  • An icon. This is primarily for VTube Studio, but you may use it for other things if you wish.

At the end of an illustration commission, you will receive the following:

  • A PSD document of the illustration.
  • Any sketches and reference images created.

At the end of an illustration and rigging commission, you will receive all of the files as standard from both a rigging and illustration commission as stated above.
